Terms of Service

1. Acceptance of Terms

By downloading, installing, or using DTI Guide ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legal agreement between you and DTI Guide.

2. App Description

DTI Guide is an application that provides theme and customization information. The App:

  • Displays content and information about themes
  • Provides personalized features through optional Roblox login
  • Shows advertisements through Google AdMob to support app development
  • Allows users to upload and share screenshots ("Fits") from Dress to Impress
  • Does not modify your device or its settings
  • Collects limited user information as detailed in our Privacy Policy

3. Use License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use the App on devices that you own or control
  • Access and view the App's content for your personal, non-commercial use
  • Upload content in accordance with these Terms

This license does not grant you any rights to the underlying software, algorithms, or intellectual property of the App.

4. Restrictions

You agree not to:

  • Modify, reverse engineer, decompile, or attempt to extract the source code of the App
  • Remove any copyright or proprietary notices from the App
  • Use the App for any illegal or unauthorized purpose
  • Transfer, sublicense, or resell the App to third parties
  • Attempt to circumvent any technological measures implemented to control access to the App
  • Use automated systems or software to extract data from the App (scraping)
  • Interfere with or disrupt the App's servers or networks
  • Attempt to circumvent, disable, or interfere with advertisements
  • Use ad-blocking software or similar technologies to prevent ad display
  • Create fake accounts or engage in fraudulent activity
  • Violate any applicable laws or regulations while using the App

5. Intellectual Property

The App, including all content, features, and functionality, is owned by DTI Guide and is protected by copyright, trademark, and other intellectual property laws. You acknowledge that:

  • All rights, title, and interest in the App remain with DTI Guide
  • No ownership rights are transferred to you through these Terms
  • Unauthorized use of our intellectual property may result in legal action
  • Third-party content displayed in advertisements belongs to their respective owners

6. Advertising Terms

Our App displays advertisements through Google AdMob. By using the App, you acknowledge and agree that:

  • Ad Display: Advertisements are an integral part of the App and help support free access to our services
  • Ad Content: We do not control the content of advertisements, which are provided by third-party advertisers
  • Ad Interaction: Clicking on advertisements may redirect you to external websites or apps
  • Data Collection: AdMob may collect data about your device and usage patterns as described in our Privacy Policy
  • Personalization: Advertisements may be personalized based on your interests and activities
  • Opt-Out: You can manage ad personalization through your device settings
  • No Endorsement: The display of advertisements does not constitute an endorsement by DTI Guide
  • Third-Party Terms: Your interaction with advertisements may be subject to advertisers' terms and privacy policies

7. User-Generated Content ("Fits")

Our app allows users to upload screenshots of outfits ("Fits") from the Roblox game Dress to Impress. By uploading such content, you agree to the following terms:

  • Ownership and Rights: By uploading content, you represent and warrant that you are the owner of the content or have the right to share it. You retain ownership of your uploaded content, but grant DTI Guide a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the App and DTI Guide's business, including for promoting the App in any media formats and through any media channels.
  • Content Restrictions: You agree to only upload content that features outfits from the Roblox game Dress to Impress. Any content that does not feature Dress to Impress outfits is prohibited. Uploading prohibited content may result in the content being removed and your account being banned from uploading further content.
  • Content Standards: You must not upload content that is illegal, offensive, defamatory, violent, sexually explicit, or violates intellectual property rights
  • Removal Rights: You may remove your uploaded content at any time through the app. However, you acknowledge that DTI Guide may retain cached or archived copies of the content. If your content has been featured in promotional materials prior to removal, DTI Guide may continue to use those materials.
  • Content Moderation: DTI Guide reserves the right to review and remove any uploaded content that violates these Terms or that we deem inappropriate, offensive, or otherwise objectionable.
  • No Compensation: You understand and agree that you will not be compensated for your uploaded content or for DTI Guide's use of such content.

8. Third-Party Services

The App integrates with certain third-party services:

  • Roblox OAuth: We use Roblox's authentication services to provide the "Sign in with Roblox" feature
  • Google AdMob: We use Google's advertising platform to display advertisements in the App
  • Your use of Roblox services is also subject to Roblox's Terms of Use
  • AdMob services are subject to Google's Terms of Service
  • We are not responsible for third-party content, policies, or practices
  • Your use of such services is at your own risk

9. Roblox Authentication

Our App uses "Sign in with Roblox" for authentication purposes. By using this feature:

  • You authorize us to access certain Roblox account information as detailed in our Privacy Policy
  • You acknowledge that Roblox may provide us with access to your Roblox ID, username, display name, and avatar URL
  • You understand that we do not have access to your Roblox password
  • You can revoke access at any time through your Roblox account settings
  • You agree to comply with Roblox's Terms of Use and Privacy Policy

10. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the App, you consent to the data practices described in our Privacy Policy.

11. Disclaimers and Limitations of Liability

11.1 Service Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
  • UNINTERRUPTED OR ERROR-FREE OPERATION
  • SECURITY OR FREEDOM FROM VIRUSES

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DTI GUIDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, DATA, OR USE
  • BUSINESS INTERRUPTION
  • PERSONAL INJURY OR PROPERTY DAMAGE
  • DAMAGES FROM THIRD-PARTY ADVERTISEMENTS

OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID TO USE THE APP, WHICHEVER IS GREATER.

12. Termination

We reserve the right to terminate or suspend your access to the App at our sole discretion, without prior notice, if we believe you have violated these Terms. Reasons for termination may include:

  • Violation of these Terms of Service
  • Fraudulent or illegal activity
  • Abuse of the App or its features
  • Uploading prohibited content
  • Interfering with the App's operation

Upon termination, your right to use the App will cease immediately, and we may delete your account and associated data.

13. Indemnification

You agree to indemnify, defend, and hold harmless DTI Guide and its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your uploaded content
  • Your violation of any third-party rights
  • Your violation of applicable laws

14. Age Requirements

The App is intended for users aged 13 and older. If you are under 18, you represent that you have your parent's or guardian's permission to use the App. This aligns with Roblox's own age requirements for account creation. Parents and guardians are responsible for monitoring their children's use of the App.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal dispute, you agree to try to resolve the matter informally by contacting us at dtithemeguide@gmail.com. We will attempt to resolve the dispute within 30 days.

15.2 Binding Arbitration

If informal resolution fails, any disputes will be resolved through binding arbitration rather than in court, except where prohibited by law. The arbitration will be conducted in English and governed by the rules of the American Arbitration Association.

15.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision will be replaced with a valid provision that most closely approximates the intent of the original provision.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal proceedings will be conducted in the courts of [Your State/Jurisdiction].

18. Apple App Store Terms

If you download the App from the Apple App Store, the following additional terms apply:

  • Apple Not a Party: These Terms are between you and DTI Guide, not Apple. Apple is not responsible for the App or its content.
  • License Scope: Your license to use the App is limited to a non-transferable license to use the App on Apple-branded products you own or control.
  • Maintenance and Support: DTI Guide is solely responsible for providing maintenance and support for the App.
  • Warranty: Apple provides no warranty for the App. Any applicable warranty is provided solely by DTI Guide.
  • Product Claims: DTI Guide is solely responsible for addressing any claims relating to the App, including product liability claims, legal compliance, or intellectual property infringement.
  • Third-Party Claims: Apple has no obligation to investigate, defend, settle, or discharge any third-party claim that the App infringes intellectual property rights.
  • Export Control: You represent that you are not located in a country subject to U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties.
  • Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19. Google Play Store Compliance

If you download the App from Google Play, you agree to comply with Google Play's terms and policies:

  • App Distribution: The app is made available through Google Play and is subject to Google Play's terms and policies
  • Content Policy: We comply with Google Play's content policies and developer guidelines
  • Data Safety: We provide accurate information about our data collection practices in accordance with Google Play's Data Safety requirements
  • User Safety: We implement measures to protect user safety and comply with Google's user safety policies
  • Privacy Requirements: We comply with Google Play's privacy requirements and provide clear privacy disclosures
  • Advertising Policies: Our advertising practices comply with Google Play's advertising policies
  • Age-Appropriate Content: Content and advertisements are appropriate for our target age group
  • Update Compliance: App updates will continue to comply with Google Play policies

20. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Updating the "Last updated" date at the top of these Terms
  • Providing notice through the App for significant changes
  • Sending email notifications if contact information is available

Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

22. Entire Agreement
